By downloading, accessing, or using SafeNest, you agree to these Terms. If you do not agree, do not use the Service.
1. What SafeNest is — and is not
SafeNest aggregates publicly available records — crime statistics, government offender registries, FEMA flood data, EPA environmental databases, education statistics, and census data — into neighborhood reports for US addresses. SafeNest provides information for your personal, non-commercial awareness. It does not provide legal, financial, real estate, or professional advice, and it does not guarantee the safety, character, or suitability of any location, school, or person.
2. Not a consumer reporting agency (FCRA)
SafeNest is not a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"), and its reports are not "consumer reports." You may not use SafeNest, in whole or in part, to determine any person's eligibility for credit, insurance, employment, housing or tenancy, government benefits, or any other purpose that would require FCRA compliance. Using the Service for such purposes is a violation of these Terms and may violate federal law.
3. Registry information — prohibited uses
Offender registry information is provided solely for public awareness and safety, consistent with the purposes for which states publish it. You may not use any information obtained through SafeNest to harass, threaten, intimidate, stalk, injure, or discriminate against any individual, or to commit any crime against any person. Misuse of registry information may itself be a criminal offense under state and federal law. Registry records are maintained by government agencies; SafeNest does not verify, and cannot guarantee, their accuracy, completeness, or currency. Individuals with similar names may be confused — never take any action based on registry information without independently verifying it with the issuing agency.
4. Data accuracy disclaimer
Public records lag reality. Agencies update databases on different schedules, records contain errors, addresses are approximated, and estimates (including safety grades, school scores, property tax figures, and offender counts, which may be approximate) are derived values, not certified facts. SafeNest reports may be incomplete, outdated, or inaccurate. Always verify information with primary sources before making any decision — including where to live, buy, or send your children to school. Your reliance on any information from the Service is at your own risk.
5. Scores and grades are opinions
SafeNest's grades, scores, and percentiles are algorithmic summaries reflecting our methodology and weighting choices applied to public data. They are informational opinions, not statements of fact about any neighborhood, school, or institution, and not predictions of future safety or performance.
6. Acceptable use
You agree not to:
- Use the Service for any FCRA-regulated purpose or any unlawful purpose
- Use the Service to harass, stalk, or harm any person, or to locate a specific individual
- Scrape, harvest, resell, or redistribute the Service's data or reports commercially
- Reverse engineer, copy, or create derivative works of the app
- Circumvent Premium restrictions, rate limits, or security measures
- Use the Service in violation of fair housing laws, including to steer or discriminate
We may suspend or terminate access for violations of these Terms.
7. Subscriptions and purchases
SafeNest Premium is an auto-renewing subscription billed through your Apple ID. The price and term are shown in the app before purchase. Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period, via iPhone Settings → your name → Subscriptions. Payment is charged to your Apple ID at confirmation of purchase. Apple's refund policies apply to all purchases; refund requests are made through Apple at reportaproblem.apple.com. Premium features (including monthly full-search allotments) reset on the schedule shown in the app and unused allotments do not carry over.
8. Sharing reports
You may share exported PDF reports for personal, non-commercial purposes (for example, with a family member, agent, or lender as part of your own housing decision). Shared reports remain subject to these Terms, including the FCRA and registry-use restrictions above, and you are responsible for how reports you share are used.
9. Intellectual property
The SafeNest app, website, name, logo, design, scores, and report formats are owned by SafeNest and protected by intellectual property laws. Underlying government data remains public; our selection, arrangement, analysis, and presentation of it is ours. These Terms grant you a limited, personal, non-transferable license to use the app on Apple devices you own or control, consistent with Apple's App Store terms.
10. Disclaimer of warranties
THE SERVICE AND ALL INFORMATION PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, OR NON-INFRINGEMENT. SAFENEST DOES NOT WARRANT THAT ANY LOCATION IS SAFE OR UNSAFE, THAT DATA IS ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFENEST AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY VALUE, ARISING FROM OR RELATED TO YOUR USE OF OR RELIANCE ON THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SAFENEST'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO SAFENEST IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS (US$50) IF YOU HAVE PAID NOTHING. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold harmless SafeNest and its owner from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right — including any misuse of registry information.
13. Apple-specific terms
These Terms are between you and SafeNest, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a US government embargo and are not on any US government prohibited-parties list.
14. Changes to the Service and these Terms
We may modify or discontinue features at any time, and may update these Terms by posting a revised version with a new effective date. Material changes will be communicated in the app where appropriate. Continued use after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law rules, and subject to any mandatory consumer protections of your place of residence. Disputes shall be resolved in the courts located in Quebec, Canada, unless applicable law requires otherwise.
